General terms and delivery information - Helmgast AB

These general terms and delivery information applies in relation to any purchase from Helmgast AB (”Helmgast”) where the buyer is a private individual consumer. The right of withdrawal only applies in relation to Helmgast's webshop (webshop.helmgast.se). Other purchases (for instance direct sale arranged by Helmgast at convention or similar) do not qualify for the right of withdrawal.

Helmgast's relationship and terms with professional traders and enterprises are governed by the Swedish Sale of Goods Act (Sw. Köplagen).

Purchase and order

Except for direct sales at special events (such as conventions), all orders and purchases are conducted through Helmgast's webshop.

A purchaser may not be under 18 years old to place an order from Helmgast.

Payment

All payments via Helmgast's webshop are conducted by Payson and the payment options available thereby. At special events payment may also be conducted through Izettle or through Swish.

Delivery and returns

Orders are subject to a delivery charge as further detailed in the webshop, upon placing your order. The cost varies depending on country of delivery.

Where the delivered goods has not been retrieved and a return has been executed by the freight company, the cost imposed by the freight company to handle the return plus and administrative fee of SEK 150 is charged. The purchaser is responsible for such costs.

Delivery times

Within Sweden, the general delivery time is 7-10 days from placing your order. For shipments abroad, the delivery takes up to 3 weeks within the European Union and up to 5 weeks to rest of the world. Helmgast does only deliver to a select number of countries. We are not able to make deliveries to other countries.

Your package is normally available at your pick up point for a period of 14 days, and must be picked up within this time frame. Goods which are not picked up in time and therefor returned to Helmgast by the freight company, are subject to a surcharge as per above.

NOTE: Deliveries around Christmas are often subject to longer delivery times. Any order within Sweden should be placed at by 7 December to make sure enough time for delivery. Any international order within European Union should be placed by 1 December, and any other international delivery by 10 November.

Your order may, depending on contents, be split into several packages. This is not subject to any charge.

Pre-orders and crowdfunding

Pre-orders , through crowdfunding or otherwise, are delivered when the products arrives to our storage. Any shipment dates or other dates communicated in relation to pre-orders are estimates. Helmgast always strives to make as good estimates as possible, but as numerous factors affects a production, no guarantees can be given in relation to those delivery estimates. In case a delivery is postponed in excess of three months from the estimated date, the purchaser may cancel the acquistion and request a repayment of any amounts paid under the purchase order. Please email info@helmgast.se to request such repayment.

Cancellation, purchase on approval or exchange rights

Order items can not be cancelled, unless otherwise specified in these terms. Helmgast does not apply purchase on approval or grant any exchange rights.

Right of withdrawal

As a private individual consument you are entitled to a right of withdrawal. This means, you may withdraw from the purchase within 14 days from receiving the goods (see exemptions below). To use your right of withdrawal, please email us on info@helmgast.se with your matter, no later than the 14th day from receving the goods.

NOTE: The cost for returning the goods are at the expense of the purchaser, i.e. Helmgast does not cover such cost for returning the items. The goods shall be packed and wrapped in a manner similar to that used by Helmgast upon delivery. 

In order to be able to use your right of withdrawal, the goods may not be used or damaged. The goods may however be inspected. Repayment of the purchase is usually executed within 14 days upon receipt of the returned goods.

Exemptions from the right of withdrawal: The right of withdrawal does not apply for purchases where the goods have been made at special request or is otherwise custom-made, for instance purchases of unique books in a crowdfunder campaign, right to influence illustrations, take part in the creation of a scenario or similar.

By downloading any pdf or other digital material provided by Helmgast as part of your pruchase, prior to the expiry of any right of withdrawal lapses, you irrevocably waive your right to invoke your right of withdrawal.

Complaints

Complaints, e.g. for faulty or damages goods, are made to info@helmgast.se.

Processing of personal data

In connection with an order, your personal data is used to manage your order and execute delivery. Upon executing a purchase from us, approval of use, storage and processing of personal data in our enterprise in order for us to fulfil our duties to you as a customer, will be made. Personal data is continously deleted, to protect your personal integrity. Helmgast does not provide your personal data to any third party, other than to be able to fulfil delivery to you and indirectly to suppliers of IT-services, and where such data is shared, acts to ensure that the third party has at least as strict view on sharing of personal data as Helmgast.

You are entitled to receive information on what personal data we have on file in relation to you. If such personal data is incorrect, incomplete or irrelevant, you may, and we shall promptly, make sure such information is deleted or updated. Please contact us at info@helmgast.se to request an extract of personal data in relation to you.

Force Majeure

In no event shall Helmgast be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; it being understood that Helmgast shall use reasonable efforts to resume performance as soon as practicable under the circumstances.
